The Responsible Declaration is a document designed to streamline the procedures for importing cosmetics and personal hygiene products. It has been in effect since the enactment of Law 10/2013, which eliminated the controls previously carried out by the Spanish Agency of Medicines and Medical Devices (AEMPS) before granting authorization to importing companies, which had to demonstrate compliance with the established regulations.
Since 2013, importers of cosmetic products and personal hygiene items only need to submit this document, which guarantees compliance with a code of good practices in the import process.
However, as importers, one should not fall into the error of thinking that the streamlining of procedures means there are no longer any controls. The Responsible Declaration is designed to avoid delays, but inspections of imported cosmetics and personal hygiene products can be carried out at the destination customs. Non-compliance with the regulations has the same consequences as before the new legislation came into effect. The Technical Inspection Committee (CTI) conducts inspections to prevent the entry of illegal products.

Usefulness of the Responsible Declaration for cosmetic importers
The submission of the Responsible Declaration streamlines procedures for importing companies but also has other benefits:

- Serves to verify that the importing company has adequate facilities and safety measures for the storage of products.
- Ensures that importers comply with the regulatory requirements for importing cosmetic products.

The Responsible Declaration document signed by the importer requires having warehouses approved by AEMPS and a qualified technician responsible for supervising activities related to the storage and handling of products.
An additional advantage of having this form is that it can be submitted electronically, saving a significant amount of time. However, before importing, it is necessary to notify the intention to introduce the product to the European Notification Portal (CPNP). If it is the first time importing such merchandise, a safety study must be conducted.
